GENERAL CONDITIONS FOR WORKSHOPS THOM BROUWER PHOTOGRAPHY

ARTICLE 1. DEFINITIONS

1. Workshop participant: the natural person or legal entity with whom an agreement regarding participation in a workshop has been concluded and who participates in the workshop.

2. Workshop: course, training, workshop, coaching or any other meeting with the aim of transferring and/or increasing knowledge and/or skills.

3. Conditions: these general terms and conditions. ARTICLE 2: APPLICABILITY OF GENERAL CONDITIONS

1. These conditions apply to all quotations, offers, agreements and deliveries of services or goods by or on behalf of 'Thom Brouwer Photography'.

2. Deviation from these conditions is only possible if this has been expressly agreed in writing by the parties.

3. Registration in the manner stated in Article 3 implies acceptance of the applicability of these conditions.

4. Applicability of general terms and conditions of the workshop participant is excluded insofar as they conflict with these terms and conditions.

ARTICLE 3. REGISTRATION AND CONFIRMATION OF WORKSHOP

1. Registration for the workshops provided by 'Thom Brouwer Photography' can be done by the workshop participant by purchasing the desired workshop in the webshop at www.thombrouwer.nl, by registering by telephone, by registering via the contact form at www .thombrouwer.nl, or by registering by e-mail.

2. A registration made in one of the ways stated in the previous paragraph will always be confirmed by e-mail by 'Thom Brouwer Photography'. By sending this confirmation, the agreement regarding participation in the workshop in question is concluded. However, proof of the conclusion of the agreement can also be proven by the parties by other means.

3. The order confirmation reflects the (content of the) agreement, unless there is proof to the contrary. ARTICLE 4. PRICES OF WORKSHOPS

1. For any form of registration, the workshop prices apply, as stated on www.thombrouwer.nl at the time of registration.

2. The workshop prices include the costs for the course materials, unless stated otherwise.

3. 'Thom Brouwer Photography' falls under the small business scheme (KOR), which applies from 2020. This means that 'Thom Brouwer Photography' is exempt from payment of VAT, and therefore no VAT rate is charged on the prices.

4. Prices can be adjusted due to unforeseen circumstances.

ARTICLE 5. PAYMENT

1. The workshop participant has the option to pay immediately upon registration via the webshop.

2. After registration in all other ways as stated in article 3, 'Thom Brouwer Photography' will send an invoice by e-mail.

3. Payment by the workshop participant must be made within the period stated on the invoice, by deposit into a bank account designated by 'Thom Brouwer Photography'. If the workshop fee is not paid on time, the right to participate will lapse.

4. If the workshop participant does not pay or does not pay on time, the resulting costs for 'Thom Brouwer Photography' will be borne by the client/workshop participant. These costs include all judicial and extrajudicial costs, such as the costs of summons, collection, counsel/attorney. The extrajudicial costs are set at at least 15% of the amount to be claimed.

5. If full payment of the workshop price has not been received by 'Thom Brouwer Photography' before the start of the workshop, the workshop participant is not entitled to participate in the workshop, without this releasing the workshop participant from the obligation to pay. of the full workshop price plus any additional costs.

ARTICLE 6. MOVE DATA WORKSHOP BY THOM BROUWER PHOTOGRAPHY

1. A workshop can be moved to another date up to 36 hours before the agreed date.

2. If the workshop participant cannot participate on the reserve date stated in the workshop information, the possibility will be examined in consultation with 'Thom Brouwer Photography' to determine whether the participant can participate in another workshop.

3. Not being able to participate in the workshop on the stated reserve date is not a valid reason for canceling the workshop and does not entitle you to a refund.

ARTICLE 7. CANCELLATION OF WORKSHOP BY THE WORKSHOP PARTICIPANT

1. Cancellation by the workshop participant of the agreement relating to a workshop is only possible up to four (4) weeks before the planned workshop.

2. In case of cancellation up to four (4) weeks before the workshop, the amount already paid by the workshop participant will be refunded, minus € 25 cancellation costs. In case of cancellation from four (4) weeks up to one week before the workshop, 50% of the workshop amount due will be charged as cancellation costs. In case of cancellation within one (1) week before the workshop, the full course fee is due and the workshop participant is not entitled to a refund of the amount already paid.

3. Cancellation by the client/workshop participant of the workshop after the start of the workshop is not possible.

4. No cancellation costs will be charged if there is a valid and demonstrable reason for cancellation. This could include death or illness and is determined in consultation with 'Thom Brouwer Photography'.

ARTICLE 8. OBSTACLE OF THE WORKSHOP PARTICIPANT

1. If a workshop participant is unable to participate in the workshop, replacement by another participant is possible, provided that the replacement is registered with 'Thom Brouwer Photography' by e-mail or telephone no later than 24 hours before the workshop. No additional costs are due for this replacement.

2. An prevented workshop participant can, upon request, be transferred once to the same workshop on different dates, if available. If you transfer within four (4) weeks before the planned workshop, €20 administration costs will be charged. If you transfer within a week before the workshop, these costs amount to 25% of the course price, with a minimum of €20.

ARTICLE 9. CANCELLATION BY 'THOM BROUWER PHOTOGRAPHY'

'Thom Brouwer Photography' reserves the right to cancel the workshop up to 36 hours before the workshop. The workshop participant will be informed of this without delay. 'Thom Brouwer Photography' will refund the course fee paid by the workshop participant. If possible, 'Thom Brouwer Photography' offers the workshop participant an alternative. If the workshop participant makes use of this, the workshop fee will not be refunded.

ARTICLE 10. LIABILITY

1. 'Thom Brouwer Photography' is not liable for any damage caused by or related to participation in a workshop of 'Thom Brouwer Photography' or the cancellation of the workshop by 'Thom Brouwer Photography', unless 'Thom Brouwer Photography' ' intent or gross negligence can be accused.

2. If 'Thom Brouwer Photography' is liable for any damage at any time despite the provisions of paragraph 1, this will be limited to a maximum of the invoice amount.

3. Indirect damage will not be reimbursed.

ARTICLE 11. OWNERSHIP

1. The workshop materials provided become the property of the workshop participant. The intellectual property rights relating to the workshop, the workshop materials and any other pieces/products relating to the workshop are reserved by 'Thom Brouwer Photography'.

2. Without the express written permission of 'Thom Brouwer Photography', the workshop participant is not entitled to disclose, exploit or in any way reproduce data from and/or parts and/or extracts of the workshop material provided.

ARTICLE 12. APPLICABLE LAW AND JURISDICTION

1. Dutch law applies exclusively to every agreement between the parties.

2. The Dutch court in the district where 'Thom Brouwer Photography' is established/practices/offices has exclusive jurisdiction to hear any disputes between parties, unless the law prescribes otherwise.

3. If one or more provisions of these general terms and conditions are deemed unreasonably onerous in legal proceedings, the other provisions will remain in full force.
